Adoption of Civil code has long been a big national issue and there were rulers who did not include lofty national feeling when the lawyers denounced as such. At a time when Serbia only exercised its state independent. It was the third in a row of the law in Europe after the French and Austrian code. Adoption of Serbian Civil code is the result of a desire to regulate the emerging concerns after the edict of 183. year. This code is an abbreviated version of the Austrian code. Work on the new Serbian Civil code was initiated by knez Miloš Obrenović, who with the help of the Austrian authorities, a lawyer and writer Jovan Hadzic on the development of the Civil code . Jovan Hadzic was used in the preparation of Serbian Civil code Austrian Civil code in abbreviated form, with the introduction of the institution of Sava`s Serbian Zakonopravilo and customary law. So Serbian Civil code built on the basis of Roman law through the Austrian Civil code through Sava`s Zakonopravilo. Hadzic was drafted Serbian Civil code, which was accepted by the legislative committee and promulgated the code 25. 03. 1844. year.
